Key Workplace Solutions Pty Ltd provides Workers Compensation Consultation and Work, Health & Safety advice and Consultation services to employers and third parties as required and requested.

Key Workplace Solutions Pty Ltd is committed to protecting your privacy in accordance with the Privacy Act 1988 and the Australian Privacy Principles. The following Privacy Policy sets out the current policy and practices that Key Workplace Solutions Pty Ltd is governed by in relation to the collection, handling, use and disclosure of personal information.

The Privacy Policy governs all personal information collected by and provided to Key Workplace Solutions Pty Ltd in the course of their work in relation to Workers Compensation Consultation and Work, Health & Safety advice and Consultation. The Privacy Policy is adhered to by all persons directly employed by Key Workplace Solutions Pty Ltd.

What is personal information, what information do we collect and how do we use it ?

Personal information is any information or opinion about that individual that can be used to identify an individual. This information maybe provided by the individual directly or via another party (the employer) to Key Workplace Solutions Pty Ltd.

The above may include what is considered to be sensitive information (such as health information). Key Workplace Solutions Pty Ltd only collects information that is required to assist us in providing the above noted services of Workers Compensation Consultation and Work, Health & Safety advice and Consultation to employers and third parties as required and requested.

In general, the following information is kept:

  • Identifying information such as name, address, employer details and employment details where applicable
  • Sensitive information concerning the relevant workers compensation claim, injury or Work Health & Safety matter we have been engaged to assist with
  • Information from third party service providers such as rehabilitation providers, investigators, legal practitioners, medical practitioners, Case Manager or Injury Management Advisors at Managing Agents and insurers, iCare, SIRA and other government regulatory authorities and other unnamed experts or consultants for the purposes of assisting in managing a workers compensation claim or a Work Health & Safety matter that we have been engaged to provide advice on.

Sensitive information will be collected, in most cases, directly from the employer who engages our services, however there may be times when we obtain sensitive information from the individual directly as well.

Where we are able to and it is practicable to do so, we will seek consent from the individual concerned prior to collecting or obtaining their sensitive information. At the time of seeking consent we will inform the individual where we are able to and if it is practicable to do so of the purpose of collection or in the case that we are permitted by law to make the collection.

Key Workplace Solutions Pty Ltd can confirm that the only times that personal information provided will be used or disclosed will be in the following scenarios:

  • In the management of a workers compensation claim or Work Health & Safety matter we have been engaged to provide guidance on.
  • An alternate purpose which has been disclosed to the individual or organisation and consent has been provided where practicable or ;
  • In the event that Key Workplace Solutions Pty Ltd are required by law to do so as permitted by the relevant Workers Compensation, Injury Management or Work Health & Safety Legislation.

Key Workplace Solutions Pty Ltd may disclose personal or sensitive information to third party service providers noted above where this information will assist in the management of a workers compensation claim or to provide the Work Health & Safety advice we have been contracted to provide.

Key Workplace Solutions Pty Ltd will take all reasonable steps to ensure that the third parties noted above are bound by the same Privacy Act of 1988 and the Australian Privacy Principles and do use any personal or sensitive information provided for any other purpose then what has been noted within this Privacy Policy.

Key Workplace Solutions Pty Ltd will not accept any responsibility or liability for use of personal or sensitive information by a third party that has been unauthorised.

Security and Access to, and Correction of Information that is Held About Individuals or Organisations

Key Workplace Solutions Pty Ltd takes the protection of personal and sensitive information seriously and it is a priority for our organisation. Key Workplace Solutions Pty Ltd will endeavour, wherever possible, to take reasonable steps to protect all personal and sensitive information from misuse, unauthorised access, disclosure or modification.

Where any personal or sensitive information is no longer required, we take reasonable steps to destroy this information or deidentify it.

Key Workplace Solutions Pty Ltd we are committed it ensuring any information that is kept is correct and up to date. We will take all reasonable actions to ensure that personal and sensitive information that is collected, used or disclosed by Key Workplace Solutions Pty Ltd is up to date, complete, and accurate.

If Key Workplace Solutions Pty Ltd holds personal or sensitive information regarding an individual or organisation, they may request access the relevant personal or sensitive information pertaining to only that individual (themselves, not the organisation as a whole).

Key Workplace Solutions Pty Ltd is able to deny access to personal or sensitive information in certain circumstances. Please note that there may be an administration fee charged to the requesting party to provide the requested access to nominated personal or sensitive information.

Access maybe requested to personal or sensitive information for an individual or organisation pertaining to only that individual (themselves, not the organisation as a whole) from Key Workplace Solutions Pty Ltd at any time by contacting the Privacy Officer via email at privacy@keyws.com.au .

The information or access request will then be dealt with by Key Workplace Solutions Pty Ltd in a timely manner.

If it is established that personal or sensitive information pertaining to only that individual (themselves, not the organisation as a whole), is incorrect, inaccurate, incomplete, misleading or out of date, Key Workplace Solutions Pty Ltd will take reasonable actions to rectify this so that the correct information is used and is accurate, complete, not misleading, up to date and relevant.

If access is denied or personal or sensitive information is not provided, Key Workplace Solutions Pty Ltd will provide you with the reasoning behind this denial in writing.

Do We Send Information Overseas ?

Information is not distributed overseas unless prior consent has been provided by the nominated individual or organisation.

Marketing

Key Workplace Solutions Pty Ltd will not use any personal or sensitive information for an individual for the purposes of marketing.

Personal or sensitive information for individuals or organisations is never distributed to third parties for the purposes of allowing them to direct market products and services.

Complaints in Relation to Privacy

Key Workplace Solutions Pty Ltd will upon receipt of a complaint, address the complaint in the most relevant and appropriate format possible and will then issue a response to the complainant outlining the measures undertaken to resolve the complaint lodged.

Changes to the Key Workplace Solutions Pty Ltd Privacy Policy

Key Workplace Solutions Pty Ltd may update or amend the Privacy Policy at any time should the need arise or to ensure that the Privacy Policy continues to adhere to the Privacy Legislation of Australia 1988 and the Australian Privacy Principles.
