How do I find out who my workers compensation insurer is ?

Most Employers in NSW are insured via iCare and their claims are managed by Employers Mutual Ltd.  This is unless you are with a specialist insurer such as Club Employers Mutual or Catholic Church Insurances.  Key Workplace Solutions are able to assist you with this process and make enquiries on your behalf

We never had a claim before, what are my obligations as an employer ?

As an employer, you have several obligations under the relevant Workers Compensation and Injury Management Acts in NSW as follows:

  • You are required to report any injury that has resulted in time loss and/or medical treatment to your workers compensation insurer/agent within 5 working days.
  • If you are unsure, reporting as a notification only is highly recommended.
  • You are required to offer and provide suitable duties for an injured worker.
  • You are required to liaise with all relevant parties in relation to the workers compensation claim including but not limited to – the Injured Worker, the Agent/Insurer, the Treating Doctor, the Rehabilitation Provider, your Workers Compensation Insurer.
  • You must have a Return to Work Program.

Injured Workers are required to provide a WorkCover Certificate of Capacity throughout their claim and should not be allowed on site to complete any duties without a valid certificate.

What is a WorkCover Certificate of Capacity ?

A WorkCover Certificate of Capacity (WCCOC) is a medical certificate that is completed mostly by the Treating Doctor or Worker’s General Practitioner at the initial consultation and throughout the life of the claim

The WCCOC includes relevant information such as the date of injury, diagnosis, restrictions, treatment currently being undertaken and the treatment plan moving forward..

The worker is obligated to provided these to all relevant parties involved in the claim throughout the life of the claim and until they obtain a Pre-Injury Duties

What are suitable duties ?

Suitable duties are duties that encompass, wherever possible, elements of the Injured Worker’s Pre-Injury Duties but have restrictions dependant on the type of injury that the Injured Worker is suffering from.

Suitable Duties should be meaningful and relevant to their employment. These duties should be placed onto a Return to Work Plan and updated every time there is a change in capacity including hours, restrictions and Treating Doctor Reviews

Who is iCare Workers Insurance and what is their role in the NSW Workers Compensation Scheme

Amongst other things, iCare have been appointed by the NSW State Government to provide workers compensation insurance to employers in NSW.  iCare acts for the Nominal Insurer as well as providing services for them

How is my premium calculated ?

Your premium is calculated by using your wages and then multiplying this with your Industry Classification Code to provide you with your Average Performance Premium or Basic Tariff Premium.

If the Average Performance Premium/Basic Tariff Premium is over $30,000, you are considered by iCare to be a Medium to Large Employer and experience rating is then incorporated into your premiums.

For a Small Employer, the premium calculation formula is as follows:

 

Premium = APP + D + M + ESI – PD – A + Q + C

 

APP – Average Performance Premium D – Dust Disease Contribution M – Mine Safety Fund Premium Adjustment ESI – Employer Safety Incentive PD – Performance Discount A – Apprentice Incentive Discount Q – Premium Adjustment Contribution C – Catastrophic Claims Contribution

 

For a Medium to Large Employer, the premium calculation formula is as follows:

 

Premium = (APP x CPA) + D – M – ESI – ESR – PD – A + Q + C
